These Terms & Conditions (“Terms”) govern your access to and use of the Fit Fest Birmingham website, ticketing pages, registrations, sponsorship and vendor applications, and your attendance at Fit Fest Birmingham (the “Event”). By purchasing a ticket, registering, applying, or attending, you agree to these Terms.
1) Definitions
- “Fit Fest,” “we,” “our,” “us” refers to Fit Fest Birmingham and its organizers, partners, contractors, and volunteers.
- “You,” “attendee” refers to any person visiting the website, purchasing tickets, registering, or attending the Event.
- “Vendors” refers to businesses or individuals offering goods/services at the Event.
- “Sponsors” refers to businesses or individuals purchasing sponsorship packages or promotional opportunities.
2) Ticket Purchases & Admissions
Tickets may be sold through third-party platforms (such as Eventbrite, Square, SweatPals, Stripe, or other approved processors). Your purchase is subject to these Terms and any applicable platform terms.
- Ticket Types: Ticket tiers and benefits are described on the Tickets page at time of purchase.
- Entry: Admission requires a valid ticket/confirmation and may require ID.
- Pricing: Pricing, promotions, and availability may change at any time.
- Transfers: Ticket transferability (if allowed) will be stated at checkout or on the Tickets page.
- Resale: Unauthorized resale, duplication, or fraud may result in denied entry without refund.
3) Refund Policy
All sales are final unless a written refund policy is provided on the Tickets page or during checkout. If refunds are permitted, they will be processed according to the stated policy and may be subject to platform processing fees or deadlines.
Fit Fest reserves the right to deny refunds for tickets obtained through unauthorized sources, fraudulent activity, chargebacks, or violation of these Terms.
4) Event Changes, Cancellations & Force Majeure
Fit Fest is a live event and details may change. We may adjust the schedule, lineup, programming, vendors, venue layout, and start/end times at any time.
Fit Fest is not responsible for delays, disruptions, or cancellations due to circumstances beyond our control, including but not limited to weather, acts of God, public safety concerns, government restrictions, venue issues, labor disputes, power/internet outages, or other emergencies (“Force Majeure”).
5) Assumption of Risk (Fitness & Activity Disclaimer)
The Event may include workouts, fitness classes, wellness activities, demonstrations, equipment, loud music, crowds, and physical exertion. By attending or participating, you acknowledge and accept the inherent risks of injury, illness, allergic reaction, or other harm.
- You are responsible for determining whether activities are appropriate for your health and fitness level.
- You should consult a medical professional before participating if you have any concerns.
- You agree to follow all instructions, rules, and safety guidance provided by Fit Fest staff and instructors.
6) Release of Liability
To the fullest extent permitted by law, you agree to release and hold harmless Fit Fest, its organizers, partners, sponsors, vendors, staff, volunteers, contractors, and venue operators from any claims, damages, losses, liabilities, costs, or expenses arising from or related to your attendance or participation, including personal injury, property damage, theft, or other loss.
Fit Fest does not provide medical care. Emergency services may be limited depending on venue capabilities.
7) Code of Conduct
Fit Fest is a community-driven experience. We expect respectful behavior from all attendees, vendors, and sponsors. Fit Fest reserves the right to remove any person without refund for behavior that is unsafe, disruptive, abusive, discriminatory, illegal, or violates venue rules.
8) Vendors & Sponsors
Vendors and sponsors operate independently. Fit Fest does not endorse or guarantee any vendor or sponsor products, services, claims, or promotions. Any transactions or interactions with vendors/sponsors are solely between you and that party.
Vendor and sponsor agreements, placement, deliverables, and deadlines may be governed by separate written contracts.
9) Photography, Video & Media Release
The Event may be photographed, filmed, or recorded. By attending, you grant Fit Fest permission to use your image, likeness, voice, and appearance in any media now known or later developed, for promotional or informational purposes, without compensation.
If you have concerns, please contact us prior to the Event and we will make reasonable efforts to accommodate, though we cannot guarantee exclusion from all background footage.
10) Website Use & Intellectual Property
All website content, branding, graphics, and materials are owned by Fit Fest or used with permission. You may not copy, reproduce, distribute, scrape, or create derivative works without written consent.
You agree not to misuse the website, submit false information, attempt unauthorized access, or interfere with website functionality.
11) Third-Party Services & Links
Our website may link to third-party platforms and services (ticketing, payments, maps, social platforms, sponsors, vendors). Fit Fest is not responsible for third-party content, policies, or practices. Your use of those services is subject to their terms and privacy policies.
12) Communications
By purchasing tickets or submitting forms, you may receive transactional emails (confirmations, receipts, updates) and—if you opt in—marketing communications. You can unsubscribe from marketing at any time.
13) Limitation of Liability
To the fullest extent permitted by law, Fit Fest will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of your use of the website or attendance at the Event.
14) Governing Law
These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles. Any dispute arising under these Terms shall be brought in a court of competent jurisdiction located in Jefferson County, Alabama, unless otherwise required by law.
15) Changes to These Terms
We may update these Terms from time to time. The most current version will be posted on this page with the “Last Updated” date. Continued use of the website or attendance at the Event constitutes acceptance of the updated Terms.
